BESTU — GENERAL TERMS AND CONDITIONS OF SALE AND USE
Updated version • 18 September 2026
These General Terms and Conditions govern the purchase and use of BESTU, a 30-day digital programme dedicated to wellbeing, personal awareness and habit building. Before purchasing, the user is invited to read these Terms and Conditions, the Privacy Policy, the Cookie Policy and the “How BESTU Works” page carefully.
1. Seller and contact details
The service is offered by Enrica Pizzoferrato, operating under the BESTU / BESTULAB brand.
Business address: Strecia Du Ja 2, 6921 Vico Morcote, Switzerland.
E-mail: support@bestulab.com
Website: bestulab.com
2. Requirements for purchase and use
BESTU is intended exclusively for persons aged 18 or over.
By making a purchase, the user declares that they are at least 18 years old, have the legal capacity to enter into the contract and provide accurate and up-to-date information.
3. What the user purchases
Once payment has been completed and personal access has been activated, the purchase entitles the user to:
- personal access to the BESTU private member area;
- access, before Day 1, to preparation content and information made available in the private member area;
- access to the 30-day BESTU digital programme, with content organised day by day, small daily actions, reflection questions, checklists and BESTU materials;
- access to BESTU community spaces available in the private member area, according to the available features and community rules;
- an FAQ section and support for matters relating to access, the private member area and how the programme works;
- future updates, additions and new content that BESTU decides to include in the programme/product purchased, at no additional cost. Future updates provided at no additional cost do not include any new products, programmes, services, consultations, events, subscriptions or standalone offers that BESTU may develop in the future and offer separately for a fee.
BESTU is not a recurring subscription, unless a different offer is proposed and separately accepted by the user in the future. The initial purchase does not authorise recurring charges that have not been expressly accepted.
4. How the programme works
BESTU has one group start on the first Monday of every month. Regardless of the day on which the purchase is completed, the user is assigned to the first Monday of the month following the purchase date, unless otherwise expressly stated in the offer before payment.
The programme is structured from Day 1 to Day 30. Day 1 is shared with the assigned group and content is made available progressively according to the programme schedule. In addition to the main content, some days may include reminders or additional content released at specific times of the day. The 30-day duration describes the structure of the programme and does not require the user to complete every stage in 30 consecutive days.
Completing Day 30 does not automatically end access to the BESTU content purchased. Access will continue for as long as BESTU keeps the product and the related infrastructure available, subject to technical changes, discontinuation of the service or circumstances beyond BESTU’s reasonable control. In the event of substantial changes, BESTU will adopt reasonable solutions taking users’ rights into account.
Participation in the community is optional. The user may follow the programme without posting content, except for the data necessary to create and manage the account and provide the service.
5. Price, currency and taxes
The applicable price is the price clearly shown on the landing page and in the Stripe checkout at the time of purchase.
BESTU may be offered in different currencies depending on the version of the page or payment link. Before confirming the order, the user can see the currency and the total amount that will be charged.
Any applicable taxes, VAT or other charges are handled and displayed in accordance with the applicable rules and sales configuration. The user must check the total amount shown at checkout before proceeding with payment.
BESTU may change prices for future purchases. A later price change does not affect a purchase that has already been completed.
6. Payment through Stripe
Payments are processed through Stripe. BESTU does not store full payment card details when these are processed directly by Stripe.
The order is completed when payment is authorised and the user receives the related electronic confirmation. If payment is declined, cancelled or not completed, access is not due.
Any fees charged by the bank or card issuer, or arising from currency conversions outside BESTU, are borne by the user.
7. Conclusion of the contract
Before payment, the user must be able to review the essential characteristics of the offer, the price and the currency and correct any errors in the information entered, according to the features available at checkout.
The contract is concluded when the purchase and payment are confirmed. Confirmation is sent electronically to the address provided by the user.
These Terms and Conditions must be made available before purchase and the user must have the opportunity to read and accept them. The applicable version is the version in force at the time of purchase.
8. Initial access and preparation for the programme
After payment is confirmed, the user receives instructions for accessing their BESTU private member area. The private member area shows the assigned start date and, before Day 1, the preparation content and information made available by BESTU.
Access to the 30-day programme begins on the first Monday of the month following the purchase. From Day 1, content is made available progressively according to the programme structure and the applicable release rules.
If, due to a technical problem attributable to BESTU, access to the purchased service is not made available as expected, BESTU will take reasonable steps to restore access and, where applicable, will provide the remedies required by applicable law.
9. Withdrawal, cancellation and refunds
For purchases governed by Swiss law, there is no general statutory right of withdrawal or change of mind after the purchase has been completed, except for any mandatory rights provided by law. BESTU does not voluntarily offer a general right of withdrawal.
If the offer is made to consumers residing in countries where mandatory rules provide a right of withdrawal, those rights remain applicable and prevail over these Terms and Conditions.
For digital content or services whose performance or supply begins before the expiry of any statutory withdrawal period, BESTU will apply the mandatory rules of the applicable law, including any requirements for express consent and acknowledgement of the loss of the right of withdrawal where legally required.
Except for mandatory rights provided by law or any more favourable conditions expressly stated in the offer, no automatic refunds are provided if the user does not participate in the programme or does not complete the content.
Requests relating to payments or refunds may be sent to support@bestulab.com.
10. Educational nature and limits of the service
BESTU is an informational and educational programme dedicated to wellbeing, habits and lifestyle. It is not a medical, healthcare, psychological, dietetic or therapeutic service and does not provide personalised diagnoses, prescriptions or treatments.
The content does not replace the advice of a doctor or other qualified healthcare professional. If the user has a medical condition, a particular physical condition, is undergoing treatment, is pregnant or has doubts about the suitability of a particular activity or recommendation, they should consult their healthcare professional before applying it.
The user remains responsible for their own decisions and should stop or adapt an activity if it is not appropriate for their situation.
BESTU does not guarantee specific results in terms of health, physical fitness, weight, performance, longevity, psychological wellbeing or habit change. Results depend on numerous individual factors.
11. Account and personal access
Access to BESTU is personal and intended for the purchaser. The user is responsible for keeping their login credentials confidential and for activities carried out through their account.
Users may not systematically share credentials, accounts or access with third parties, resell access or use BESTU to allow unauthorised persons to use the service.
Where there is reasonable suspicion of abuse, fraud, unlawful account sharing or a serious breach of these Terms and Conditions, BESTU may take proportionate measures, including suspension of access, after considering the circumstances and without prejudice to the user’s mandatory rights.
12. Community rules
In BESTU spaces, users agree to behave respectfully and not to post content that is unlawful, discriminatory, threatening, harassing, fraudulent, defamatory, invasive of another person’s privacy or in breach of third-party rights.
Users must not post personal data of third parties without authorisation, nor medical reports, diagnoses, treatments or unnecessary detailed health information.
The community must not be used to provide diagnoses, prescribe treatments, promote dangerous practices, send spam or carry out unauthorised commercial activities.
BESTU may moderate or remove content and, in serious or repeated cases, restrict access to the community. Detailed community rules may be published separately and form part of the rules for using the service.
13. Intellectual property
Unless otherwise stated, original BESTU content - including text, editorial structure, materials, checklists, original graphics, video, audio and other creative content - is protected by applicable intellectual property law.
The purchase grants the user a personal, limited and non-transferable right to use the content for private purposes.
Users may not copy, republish, distribute, sell, license, make available to the public or commercially exploit BESTU content without authorisation, except where permitted by law.
References to books, podcasts, studies, authors, websites or other third-party resources remain the property of their respective owners.
14. Service availability and third-party providers
BESTU uses third-party services and infrastructure, including Lovable for the application and the website/private member area interface, Supabase for backend functions, authentication and data management, and Stripe for payments. BESTU may also use additional technical providers for ancillary functions such as e-mail, notifications, hosting or security.
BESTU takes reasonable measures to keep the service available but cannot guarantee uninterrupted or error-free operation. Maintenance, updates, network problems or outages affecting third-party providers may occur. Technical providers may change over time, provided that such changes do not unjustifiably deprive the user of the essential features of the service purchased.
In the event of significant disruptions attributable to BESTU that substantially prevent use of the purchased service, BESTU will provide reasonable remedies based on the circumstances and the user’s applicable rights.
15. Liability
BESTU is liable within the limits provided by applicable law. Nothing in these Terms and Conditions excludes or limits liability that cannot lawfully be excluded or limited.
To the extent permitted by law, BESTU is not liable for subjective results that are not achieved, for use of the content contrary to the guidance provided, for decisions made by the user while disregarding known personal circumstances or the advice of their healthcare professional, or for interruptions attributable solely to third-party services or networks beyond BESTU’s reasonable control.
These limitations do not affect consumers’ mandatory rights.
16. Privacy and cookies
The processing of personal data is described in the BESTU Privacy Policy. The use of cookies and similar technologies is described in the BESTU Cookie Policy.
When using external services such as Lovable, Supabase, Stripe or other technical providers necessary to deliver the service, the user may also be subject to the respective privacy notices and terms for processing and features managed directly by those providers.
17. Changes to the service and content
BESTU may update, improve or reorganise the project’s content and features over time, including to keep them current, secure and useful.
Changes must not unjustifiably deprive the user of the essential features of the service already purchased. Any new paid offers, services or subscriptions will not be charged without the user’s new and express acceptance.
18. Communications
Communications relating to the purchase, access, the assigned start date, security, necessary service updates and support may be sent to the e-mail address provided by the user. BESTU may also use, where enabled by the user and technically available, notifications relating to programme content or activities.
Promotional communications that are not necessary for the service will be handled in accordance with applicable law and, where required, on the basis of the user’s consent or another valid legal basis.
19. Governing law and jurisdiction
These Terms and Conditions are governed by Swiss law, without prejudice to any mandatory rights granted to consumers under applicable law.
Any disputes are subject to the jurisdiction rules provided by law. In particular, these Terms and Conditions do not limit mandatory venues or consumers’ rights to choose a competent court where such rights are provided by law.
20. Severability and changes to these Terms and Conditions
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain valid to the extent permitted by law.
BESTU may update these Terms and Conditions for future purchases. Each purchase is governed by the version made available and accepted at the time the contract is concluded. Any changes affecting existing contractual relationships will be handled in accordance with applicable law.
